Trademark infringement is governed by **Section 29** (conditions of infringement) and **Section 135** (civil remedies โ€” injunction, damages, or account of profits) of the Trade Marks Act, 1999. ## 02 What Constitutes Infringement The following actions are strictly prohibited and constitute infringement of PATOYS intellectual property. ### Copyright Infringement - Copying or republishing PATOYS product descriptions, blog articles, or website content without written permission - Downloading and reusing PATOYS product photographs or marketing images - Scraping website content using bots or automated tools - Creating derivative works from PATOYS content without authorization - Distributing PATOYS content on third-party platforms (Amazon, Flipkart, social media) without permission ### Trademark Infringement - Using the name "PATOYS", "PA TOYS", or any confusingly similar name in commerce - Selling counterfeit or fake products under the PATOYS brand name - Creating fake social media accounts, websites, or WhatsApp groups impersonating PATOYS - Using the PATOYS trademark in Google Ads, Meta Ads, or any paid advertising without authorization - Registering domain names containing "PATOYS" or variations thereof - Using the PATOYS logo, tagline "Delivering Papa's Love", or brand identity without permission ### Online Fraud & Impersonation โ€” Scam Warning PATOYS operates **exclusively at www.patoys.in**. We have **no physical retail stores** and **no authorized resellers** on third-party platforms unless explicitly stated. Beware of: fake Facebook/Instagram pages selling PATOYS products at unusually low prices; WhatsApp groups or individuals collecting advance payments and disappearing; fake websites mimicking patoys.in. Description of the infringing use (URL, screenshot, platform name) 2. Your relationship to the trademark (owner, authorized agent, or concerned party) 3. Your contact details 4. Supporting evidence (screenshots, links, purchase receipts) ## 05 Investigation and Action Upon receiving a valid infringement notification, PATOYS will: 1. Acknowledge receipt of the complaint within **24 hours**, in line with the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 2. Investigate the claim thoroughly and in good faith 3. Take appropriate action โ€” content removal, account suspension, or referral to law enforcement โ€” and aim to resolve the complaint within **15 business days** 4. Notify the alleged infringer of the complaint and action taken 5. Respond to the complainant with the outcome PATOYS reserves the right to restore removed content if a valid counter-notification is received or the complaint is found invalid. ## 06 Counter-Notification Process If your content was removed by mistake or misidentification, submit a counter-notification to **help@patoys.in** with subject _"Counter-Notification โ€” IP Dispute"_, including: 1. **Identification of removed material** โ€” description and original URL 2. **Statement of good faith** โ€” under penalty of perjury, that removal was a mistake or misidentification 3. **Your contact information** โ€” name, address, phone, email 4. **Consent to jurisdiction** โ€” courts in **Mathura, Uttar Pradesh, India** 5. **Acceptance of service** โ€” from the party who submitted the original notice 6. **Signature** โ€” physical or electronic ## 07 Repeat Infringer Policy PATOYS maintains a strict repeat infringer policy. How long does PATOYS take to respond to infringement reports? All valid complaints are acknowledged within 24 hours, in line with the IT Rules, 2021, with resolution targeted within 15 business days. Can I resell PATOYS products? PATOYS does not have an authorized reseller program. All genuine PATOYS products are sold exclusively at www.patoys.in.
